These Terms and Conditions (“Terms”) govern your access to and use of the website operated by ArigoFX (“Company”, “we”, “our”, or “us”) and the services offered through it, including but not limited to foreign exchange (Forex) trading services, market data, and other ancillary services (collectively, the “Services”). By accessing or using the website at www.arigofx.com (the “Website”) or registering for an account, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Website or any of the Services.

2. Legal Capacity and Eligibility

By accessing the Website and/or using the Services, you affirm that you:

  • Are at least 18 years of age or the legal age of majority in your jurisdiction.
  • Possess the legal capacity to enter into binding contracts.
  • Are not a resident of a jurisdiction where access to foreign exchange or derivative trading is restricted or illegal.
  • Are not a politically exposed person (PEP), nor are you on any sanctions list (e.g., OFAC, UN, EU, UK).

ArigoFx Ltd is registered at Ground Floor, The Sotheby Building, Rodney Village, Rodney Bay, Gros-Islet, Saint Lucia with registration number 2025-00368.

It is your responsibility to ensure compliance with local laws and regulations applicable to your trading activities.

4. Risk Disclosure

Trading in the foreign exchange markets involves significant risk, including the potential loss of your entire investment. You acknowledge that:

  • The leveraged nature of Forex trading can magnify losses.
  • Past performance is not indicative of future results.
  • You may lose more than your initial deposit.

5. Account Registration and Verification (KYC)

To access trading services, you must create an account and complete our Know Your Customer (KYC) process. You agree to:

  • Provide accurate, complete, and current information.
  • Promptly update your details in the event of any changes.
  • Provide valid identification and address verification documents.
  • Undergo enhanced due diligence procedures, if required.

Failure to comply may result in account suspension or termination.

6. Anti-Money Laundering (AML) Compliance

ArigoFX enforces strict Anti-Money Laundering and Counter-Terrorism Financing policies in accordance with applicable laws and international standards. We reserve the right to:

  • Monitor all transactions.
  • Report suspicious activities to competent authorities.
  • Request additional documentation at any time.

Any breach of AML obligations may lead to immediate termination of services and legal consequences.

7. Trading Services

Upon approval, you will be granted access to our trading platform. You acknowledge and agree that:

  • All trades are final and binding once executed.
  • You are solely responsible for monitoring and managing your open positions.
  • We may, at our sole discretion, modify trading conditions (e.g., margin requirements, leverage) based on market conditions.
  • We are not liable for any trading losses or missed opportunities due to delays, outages, or technical issues.

8. Deposits and Withdrawals

All deposits and withdrawals must be made through authorized channels listed on the Website. You agree that:

  • You will only use payment methods in your own name.
  • Withdrawal requests will only be processed after proper verification.
  • We reserve the right to impose fees, limits, or delays as necessary for compliance purposes.
  • Chargebacks or fraudulent transactions will be investigated and may result in account suspension.

All applicable fees, including but not limited to spreads, commissions, overnight financing, and withdrawal fees, will be transparently disclosed on the Website. You are responsible for reviewing and understanding these charges prior to trading.

All content on the Website, including but not limited to text, images, software, and logos, are the intellectual property of ArigoFX or its licensors. Unauthorized use, reproduction, or distribution is strictly prohibited.

11. Prohibited Activities

You agree not to engage in:

  • Market manipulation, arbitrage, or latency abuse.
  • Use of automated trading systems without prior approval.
  • Transmission of harmful code (e.g., viruses, malware).
  • Activities in violation of sanctions or local laws.

Violations will result in immediate termination and may be reported to regulatory authorities.

12. Limitation of Liability

To the fullest extent permitted by law, ArigoFX shall not be liable for:

  • Any loss or damage arising from trading activities.
  • Indirect, incidental, or consequential damages.
  • Interruptions, delays, or unavailability of the platform.

You agree that your use of the Services is at your own risk.

13. Indemnification

You agree to indemnify and hold harmless ArigoFX, its officers, directors, employees, and agents from any claims, liabilities, damages, or losses arising from:

  • Your use of the Website or Services.
  • Your violation of these Terms or applicable law.
  • Your infringement of third-party rights.

14. Privacy and Data Protection

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Saint Lucia jurisdiction. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Saint Lucia jurisdiction.
